The law, which was passed last week, will allow some manufacturers of prescription drugs to sell their products in Europe, but only if they have a patent for the active ingredient.
The patent for sildenafil was awarded to Pfizer, the US-based drug maker that makes Viagra, in an order from the EU, following a court decision that the European Court of Justice ruled the drug could not be sold without a licence from a UK company.
In a court filing, the EU’s High Court ruled the European Medicines Control Agency (EMA) had patented an active ingredient for sildenafil, the active substance in Viagra, in 2001.
Pfizer’s patent in 2003 was still set to expire on June 23.
The EMA’s ruling, announced on the same day, was a result of an appeal by the pharmaceutical industry, which had challenged the EU’s application to allow the manufacture and sale of its own patented drug.
The EU’s decision, which was due to take effect on July 1, has sparked a series of investigations by the drugmakers.
In its filing, EMA cited three key points in the European decision: (1) it was based on an application to grant a license from the Medicines and Healthcare Products Regulatory Agency (MHRA), (2) it was based on an application to apply for a license from the European Medicines Agency (EMA), and (3) it was based on a non-approvable patent.
The first and third points were based on the MHRA application and an EU ruling that it would be necessary for Pfizer to show that it had the right to apply for a licence from the EMA, as the EU applied to apply to Pfizer to grant a license to a company that would manufacture and supply Viagra.
The second point in the decision was based on a statement from Pfizer’s chairman and CEO, John Lees, in which Lees warned that the decision was “inadvertent and misleading”. The statement said: “Pfizer should immediately cease making and supply of Viagra, its generic drug product, and immediately seek approval from the EMA to supply its own product, including the generic Viagra product.

“As a pharmaceutical company, we are always prepared to take risks, but it is our responsibility to take every risk that we can, and always do. The EMA, the EU, and the Commission have a duty to ensure that our patients are treated for a fair and effective treatment,” he said.
